These general terms of business ("Terms") govern the relationship between the buyer and the seller URBAN DIZAJN 2021 j.d.o.o., with registered office at Ulica 141. brigade hrvatske vojske 1A, 21000 Split, Croatia, OIB: 33084023327, MB: 05362695, registered with the Commercial Court in Split, represented by board member Sanja Kumrić Beščec, contact: orderurbandesign@gmail.com, tel. +385 92 306 9642 (hereinafter: "Urban Design", "the seller"), for purchases made via the webshop at urbandesignsplit.com. By placing an order through the webshop, the buyer confirms familiarity with and full acceptance of these Terms. All matters not regulated by these Terms are governed by the Croatian Consumer Protection Act (OG 19/22, 56/22, 14/23), the Obligations Act, the E-Commerce Act and other applicable laws of the Republic of Croatia.
All product prices are stated in euros (EUR), VAT included. The price applicable to an order is the price displayed at the moment the order is placed. The total amount including delivery costs will be displayed before the buyer confirms the order. The seller reserves the right to change prices without prior notice. Product images are illustrative and may differ slightly from the actual appearance due to the buyer's display settings.
An order is concluded when the buyer presses the button explicitly confirming the obligation to pay ("Pay" / "Order with payment obligation"). The contract between seller and buyer is deemed concluded at the moment of successful payment authorisation through the Stripe system. Upon completion of the order the buyer receives an order confirmation by email containing all essential elements of the contract, constituting confirmation on a durable medium within the meaning of Art. 57 of the Croatian Consumer Protection Act. We accept all customary card payments supported by Stripe (Visa, Mastercard, Maestro, American Express, Apple Pay, Google Pay).
Delivery is made within the Republic of Croatia and, by arrangement, within EU countries. The exact delivery cost and expected delivery time are displayed to the buyer before order confirmation and depend on the weight, dimensions and destination of the shipment. If a product becomes unavailable for objective reasons, the seller will inform the buyer without delay and offer a refund or a replacement product.
Pursuant to Art. 72–79 of the Croatian Consumer Protection Act (OG 19/22), a buyer who has concluded a distance contract has the right to unilaterally withdraw from the contract within 14 days of the day the buyer or a third party designated by the buyer (other than the carrier) takes possession of the goods, without giving any reason. To exercise the right of withdrawal, the buyer must inform the seller of the decision before the deadline by an unequivocal statement sent by post (Urban Design, Ulica 141. brigade hrvatske vojske 1A, 21000 Split, Croatia) or by email to orderurbandesign@gmail.com, stating their full name, address, phone number and email. The buyer may also use the model withdrawal form provided below in these Terms. In case of withdrawal, the buyer must return the goods without undue delay and in any case no later than 14 days from the day on which they communicated the withdrawal. The goods must be returned in their original, undamaged condition and original packaging. The buyer bears the direct costs of returning the goods. The seller will refund the amount paid (including delivery costs) without undue delay and in any case no later than 14 days from the day on which the seller is informed of the withdrawal, using the same means of payment that the buyer used for the original transaction. The seller may withhold the refund until the goods have been received back or until the buyer has supplied evidence of having sent them back. The buyer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Pursuant to Art. 86 of the Consumer Protection Act, the buyer does not have the right to withdraw in the following cases: (1) service contracts fully performed by the seller, where performance began with the buyer's express prior consent; (2) contracts for goods or services whose price depends on fluctuations on the financial market; (3) contracts for goods made to the buyer's specifications or clearly personalised; (4) contracts for goods that are liable to deteriorate or expire rapidly; (5) contracts for sealed goods unsuitable for return for reasons of health protection or hygiene, if unsealed after delivery; (6) contracts for goods which are, after delivery, by their nature inseparably mixed with other items. If an order includes a product falling under one of these exceptions, the seller will inform the buyer accordingly before the order is shipped.

Pursuant to Art. 400–422 of the Croatian Obligations Act and Art. 43 of the Consumer Protection Act, the seller is liable for material defects of the goods that existed at the moment of transfer of risk to the buyer, as well as those appearing after the transfer of risk if they result from a cause that existed beforehand. The statutory warranty period for material defects is 2 years from the date of delivery. In the event of a material defect, the buyer is entitled, at their own choice, to: (a) removal of the defect (repair); (b) delivery of another defect-free item (replacement); (c) a proportional price reduction; or (d) termination of the contract and a full refund. Pursuant to Art. 10 of the Consumer Protection Act, consumers may submit a written complaint about the quality of goods or services to the seller: (a) by email to orderurbandesign@gmail.com; (b) by post to: URBAN DIZAJN 2021 j.d.o.o., Ulica 141. brigade hrvatske vojske 1A, 21000 Split, Croatia. The complaint must contain the consumer's full name, address, order number and a description of the complaint. The seller will, without undue delay and at the latest within 8 days of receiving the complaint, confirm receipt in writing, and will respond substantively to the complaint within 15 days of receipt at the latest. The seller maintains a register of consumer complaints and keeps it for at least one year from receipt.
The seller strives to ensure the accuracy and currency of all information on the website but is not responsible for possible errors in product descriptions, images or technical specifications. Product colours in the photos may differ depending on the buyer's display settings and calibration. The seller is not liable for damage caused by improper use of the products or use contrary to the manufacturer's instructions. Nothing in these Terms excludes or limits the consumer's rights arising from mandatory provisions of Croatian law.
Pursuant to the Croatian Act on Alternative Resolution of Consumer Disputes (OG 121/2016, 32/19), consumer disputes may be resolved before accredited bodies for alternative dispute resolution, for example: Mediation Centre at the Croatian Chamber of Economy, Rooseveltov trg 2, 10000 Zagreb, www.hgk.hr/centar-za-mirenje. Participation in alternative dispute resolution is voluntary for both parties.
These Terms and any relations between seller and buyer are governed by the laws of the Republic of Croatia. For all disputes the parties agree to the jurisdiction of the competent court in Split, noting that for consumers within the meaning of the Consumer Protection Act mandatory rules on territorial jurisdiction apply — the consumer may always bring proceedings before the court of their place of domicile in accordance with Regulation (EU) No 1215/2012 (Brussels I bis). Before initiating legal proceedings the buyer is asked to attempt to resolve the dispute directly with the seller at orderurbandesign@gmail.com.
The seller reserves the right to amend these Terms. All amendments are published on this page together with the update date and take effect on the day of publication. Orders placed before an amendment are subject to the Terms in force at the time the order was placed. If any provision of these Terms becomes void or unenforceable, the remaining provisions remain in force and apply to the maximum extent permitted by law.
